LiveByLunch Terms of Service
Who we are: LiveByLunch ("LiveByLunch," "we," "us"), operated by Jon Shaffer, a sole proprietor d/b/a LiveByLunch, 14433 Colorado Place, Canyon Country, CA 91387 · [email protected]
Effective date: October 17, 2026 · Last updated: October 30, 2026
1. The service
LiveByLunch helps local businesses build, publish and host a simple website by chatting with an AI assistant. You are chatting with automated software, not a person. Features may change, be added or be discontinued over time.
2. Eligibility and accounts
You must be 18+, able to form a binding contract, and using the service for a business. Logins use one-time email links. Keep your email account secure; you're responsible for activity under your account. Invite or promo codes, if offered, are personal and can be revoked.
3. Your content and AI output
- You own your content (business info, uploads) and, as between you and us, the text our AI generates for your site ("Output"). We assign to you any rights we have in Output. Our templates, looks, code and the "Built with LiveByLunch" branding stay ours. You get a license to use them on your site while you subscribe.
- You give us a license to host, copy, display, format and process your content (including with our subprocessors such as OpenAI) only to run the service.
- AI can be wrong. Review all Output before publishing. You are responsible for your site's accuracy: prices, licenses, insurance, hours and claims. Don't publish reviews, ratings, certifications or guarantees you can't back up.
- Stock photos come from Unsplash/Pexels under their licenses.
4. Acceptable Use and Content Policy
Our Content Policy (livebylunch.com/content-policy) is part of these Terms. In short: no illegal goods or services, adult or sexual content, hate or harassment, impersonation or phishing, fake social proof, violence or self-harm promotion, malware or spam, or infringement. Don't break security, scrape, overload, or resell the service. We may block publishing, disable sites (including immediately for serious risk), or terminate accounts. Where practical we'll explain why and how to fix it. To appeal a decision, email [email protected] (subject "Appeal"). Report abuse to [email protected] (subject "Abuse report").
5. Your sites, your visitors (service-provider terms)
- Sites are published at
yourname.livebylunch.com. We control the livebylunch.com subdomain and may refuse or reclaim names (e.g., trademark or misleading names). - Visitor form submissions (leads) are stored and emailed to you. You are the business responsible for your visitors' data: you must give visitors any required privacy notice (we provide a basic one you should review) and use leads lawfully (only to respond, follow anti-spam and privacy laws).
- We process visitor personal information as your service provider/processor: only to provide the service, not sold or shared, not used for other purposes, with reasonable security. We help with consumer requests and use subprocessors listed in our Privacy Policy.
- Online selling (Pro): payments run through your own Stripe or Square account. You are the seller and merchant of record, responsible for products, fulfillment, refunds, taxes and payment-processor terms. We are not a party to your sales.
6. Copyright complaints (DMCA)
We respond to notices under 17 U.S.C. §512. Send notices to our Designated Agent: Jon Shaffer, LiveByLunch, 14433 Colorado Place, Canyon Country, CA 91387 · [email protected] (subject "DMCA notice") · (323) 451-9566.
Notice must include: (1) your physical or electronic signature; (2) the work claimed infringed; (3) the infringing material and its URL; (4) your contact info; (5) a statement of good-faith belief that the use isn't authorized; (6) a statement, under penalty of perjury, that the notice is accurate and you're authorized to act.
Counter-notice (if your content was removed): your signature; the removed material and its former location; a statement under penalty of perjury of good-faith belief it was removed by mistake or misidentification; your name, address and phone; consent to federal court jurisdiction for your district (or any district where we're found, if you're outside the US) and to accept service from the complainant. We may restore the material in 10-14 business days unless the complainant files suit.
Repeat infringers: we terminate accounts of repeat infringers in appropriate circumstances.
7. Fees, subscriptions and automatic renewal
Paid plans are available. You will never be charged unless you choose a paid plan and agree to its terms, including automatic renewal, at checkout. Current plans: Basic $15/month or $153/year; Advanced $30/month or $306/year; Pro $50/month or $510/year, plus applicable taxes.
- Plans and prices: the price, billing period (monthly or yearly) and any discount for each plan are shown on our pricing page and at checkout before you subscribe. Each site needs its own subscription.
- AUTOMATIC RENEWAL: Your subscription renews automatically at the end of each billing period (monthly or yearly) at the then-current price for your plan, plus applicable taxes, and your payment method on file is charged through Stripe until you cancel. You agree to this by checking the auto-renewal box at checkout. We keep a record of your consent.
- Cancel anytime, online: go to Dashboard → Billing → Cancel subscription (or the link in any billing email). It takes a few clicks, with no phone call needed. Cancellation stops future renewals. Your site stays live until the end of the period you've already paid for. You can also cancel by emailing [email protected].
- No refunds for partial periods. We don't refund or credit unused time in a month or year, except where the law requires it.
- Complimentary access: The only free access is complimentary VIP access, granted individually by LiveByLunch at its discretion, with no card required.
- Plan changes: upgrades take effect right away with a prorated charge for the rest of the current period. Downgrades take effect on your next billing date.
- Price changes: we'll email you between 7 and 30 days before any price change takes effect, with how to cancel.
- Yearly plans: we'll send a yearly reminder before renewal with the plan, the amount and how often you're charged, and how to cancel.
- Failed payments: we'll email you and retry for 7 days. After that, your site may be taken offline (content kept per our Privacy Policy).
- Taxes: prices don't include sales tax, which may be added where required.
8. Cancellation, downloading your site, and deletion
- Cancelling: you can cancel any time from your dashboard. You keep full access until the end of the period you've paid for ("access end").
- After access ends: your owner dashboard and AI builder are locked. Your hosted site stays online for 30 more days, then goes offline.
- Downloading your site: while your plan is active, and for 1 year after access ends, an owner of the site can download it from Your sites → Download (sign-in required; only the site's owners can download it). The ZIP file contains your pages and images, your app files (on sites that have an app), and your contacts, members, orders and bookings as CSV files. Passwords, keys, tokens and other secrets are left out. Downloads may be rate-limited. After that year, the download is no longer available unless you resubscribe.
- Resubscribing: you can resubscribe at any time to restore your dashboard, builder, hosted site and download.
- Your responsibility for downloaded data: the CSV files contain personal information about your own customers, members and site visitors. Once you download them, you are responsible for keeping that data secure and for using it lawfully, as the business that controls it. We process it for you only as your service provider (see §5 and our Privacy Policy §8).
- Deletion: to have your site and data deleted, email [email protected] and we'll delete it within 45 days, except records we must keep by law. See Privacy Policy §6 for how long we keep data.
9. Disclaimers
The service is provided "as is" and "as available." We don't guarantee uptime, search rankings, leads, or business results, or that AI output is accurate.
10. Limitation of liability
To the maximum extent allowed by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or lost profits. Our total liability is limited to the greater of the fees you paid in the 12 months before the claim or $100.
11. Indemnity
You'll defend and indemnify us against claims arising from your content, your site, your sales, or your breach of these Terms.
12. Disputes
California law governs, without regard to conflict-of-law rules. Courts in Los Angeles County, California have exclusive venue.
13. Changes to these Terms
For material changes we'll email you and/or notify you in the app at least 30 days before they take effect. Continuing to use the service after that means you accept them. If you don't agree, you can cancel.
14. General
Entire agreement, severability, no waiver, assignment (we may assign in a merger), notices by email. Contact: [email protected].
